A: Because there isn't anyone to put on trial and to jail. Fundamentally wrong with the new legislation is that it assumes there is someone to sentence, before that, arrest. Al Qaeda is a non negotiable relationship. It is given to the West and the West has to live with it. There won't be anyone to arrest then sentence. If either of the forms of terrorism as the Herald describes takes place, it'll be too late. Make Laws? Argh! Don't bother. Don't bother. Don't bother. 9/11 is something to learn by, however painful. As a British journalist reported, the most frightening thing (and why the West is losing the war, every day) about "Al Qaeda" is that it's an idea.
